Rand Green  Supreme Court Declares the Constitution

Yosemite Valley

Trumble painiting of Constitutional Convention - detailONE THING was made crystal clear in the U.S. Supreme Court's ruling on Obamacare today (June 28, 2011), if it had not been clear already:  The U.S. Supreme Court, as presently constituted, cannot be relied upon to do the right thing, not even when the very efficacy of the U.S. Constitution itself hangs in the balance.

What is not only stunning but staggering is that it was not the ambivalent Justice Kennedy who sided with the Obama Administration in what is widely regarded as the most consequential case to come before the court in generations. No, this time, David Kennedy voted to uphold the Constitution.

Rather, it was the "reliably" conservative Justice John Roberts whose vote tilted the court's decision to the left, upholding Obamacare in its entirety and effectively declaring the United States Constitution unconstitutional.

True, it's not the first time in its history that the Supreme Court has rendered a decision  in diametric contradiction to Constitutional authority. It's not even the first time this week, for that matter. But never have the stakes been higher, as Obamacare is not only a brazen and unprecedented over-reach of authority by Congress and the Administration an over-reach in which the Supreme Court is now complicit -- but it is also tipping-point legislation, putting more than half of the U.S. economy in the hands of government, rather than the private sector, for the first time in our history.

The Supreme Court has in effect said that there is no limit to how much the federal government can control our lives, and the Constitution be hanged (or shredded, or relegated to the status of an irrelevant relic, or whatever it takes to get the pesky piece of paper out of the path of totalitarian socialism).

Today's court ruling also upheld the notion that the federal government can take anything it wants from anyone it wants any time it wants. Which is just another way of saying you don't own a thing. Not even your own body.

So is today's ruling final, irrevocable and irreversible? No, it could hypothetically be overturned by some future Supreme Court comprised of justices who are men of honor, who live true to their oath of office and actually uphold, rather than torture, the Constitution. But that will only happen if we have a long succession of presidents who will only appoint committed constitutionalists to the Supreme Court and a long succession of senators who will confirm such appointments. Don't hold your breath.

Since the Supremes didn't do the right thing, the only hope now is to elect a new president who will work to repeal Obamacare, and also to elect a strong majority of U.S. Senators and Representatives who will not only support the repeal of Obamacare but will insist on its repeal and then get to work undoing the many other pieces of legislation currently on the books that have shackled our economy, restricted our freedoms, compromised our national sovereignty and made a mockery of the Constitution.

The question before us at this moment is whether the voters will do the right thing in November. It all comes down to that. If Obama gets another term, if Harry Reid and Company remain in power in the Senate, America's future will be bleak, to put it mildly. But if that happens, the fault will not lie with Obama or Reid. It will lie with the voters who are more interested in getting things for free than in being free.

Otherwise put, the U.S. Supreme Court has declared the United States Constitution unconstitutional. Will the voters ratify that decision or repudiate it in November? We can excoriate Obama all we like likewise the Congress, the courts, the bureaucracy, the media and many others who have been complicit in transforming these once-free United States of America into a totalitarian socialist-fascist state. But in the end, if America goes down, there will be only the voters to blame.
